Right of Withdrawal

A. Withdrawal Policy

Introduction

Consumers have a right of withdrawal as described below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or independent professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within 30 days without providing any reason.

The withdrawal period is 30 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Xanadu Evolution e.K., Owner: Karsten Wagner, Dorotheenstrasse 62, 09113 Chemnitz, Germany, Tel.: +49 371 / 23 451 306, Email: kontakt@xanadu-evolution.de) of your decision to withdraw from this contract through a clear statement (e.g., a letter sent by post or email). You may use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising your withdrawal right before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we must refund all payments received from you, including delivery costs (except for additional costs resulting from choosing a delivery method different from the least expensive standard delivery we offer), without undue delay and at the latest within fourteen days from the day we receive notice of your withdrawal. For this repayment, we use the same payment method you used for the original transaction unless expressly agreed otherwise with you; under no circumstances will you be charged fees for this repayment.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period expires.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling them in a manner not necessary to examine their nature, characteristics, and functioning.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for which an individual choice or decision by the consumer is essential or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal does not apply to consumers who, at the time of contract conclusion, do not belong to a member state of the European Union and whose sole residence and delivery address are outside the European Union at the time of contract conclusion.

Linked/Financed Transactions

If you finance this contract through a loan and later withdraw from it, you are no longer bound to the loan agreement if both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender uses our cooperation regarding financing. If the loan has already been received by us at the time of withdrawal or return of the goods, your lender assumes our rights and obligations arising from the financed contract in relation to you regarding the legal consequences of withdrawal or return. This does not apply if the contract concerns the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives). If you want to avoid contractual binding as much as possible, exercise your right of withdrawal and withdraw from the loan agreement as well, if applicable.

General Notes

Please avoid damaging or contaminating the goods. If possible, return the goods in their original packaging with all accessories and all packaging components. Use protective outer packaging if necessary. If you no longer have the original packaging, please ensure sufficient protection against transport damage with appropriate packaging.
Please do not send the goods back to us without postage.
Please note that the above points (1-2) are not prerequisites for the effective exercise of the right of withdrawal.
